Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of ExpressYou™, including our mobile app, website, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms.

1. About the Service

ExpressYou™ provides tools to help users think through and draft messages, including coaching, message generation, message editing, screenshot-based reply features, contact-based personalization, reminders, and subscription features.

2. Eligibility

You must be at least 13 years old to use the Service. If you use the Service, you represent that you meet this requirement and that you are legally permitted to enter into these Terms.

3. Accounts and Access

To use certain features, you may need to create an account or sign in with email, Google, or Apple. You agree to provide accurate and current information and to keep your account credentials secure.

You are responsible for activity that occurs through your account, except to the extent caused by our own actions or failures.

4. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, share, retain, and delete information.

5. AI and Message Suggestions

The Service may use artificial intelligence, automated systems, curated content, and third-party model providers to generate or refine outputs. Message suggestions are provided for informational and personal drafting assistance only.

You understand and agree that:

  • Generated content may be incomplete, inaccurate, awkward, sensitive, or inappropriate
  • The Service does not guarantee any outcome, response, or relationship result
  • You are solely responsible for reviewing, editing, and deciding whether to use any generated or suggested content
  • You should not rely on the Service as legal, medical, mental health, crisis, or other professional advice

6. User Content

You may provide prompts, messages, screenshots, profile information, photos, and other content through the Service ("User Content"). You retain rights you have in your User Content, but you grant us a limited license to host, store, process, reproduce, and transmit that content as needed to operate the Service and provide requested functionality.

You represent that you have the rights necessary to provide User Content and to allow us to use it for the purposes described in these Terms and our Privacy Policy.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any law or the rights of others
  • Harass, threaten, abuse, defraud, or impersonate another person
  • Upload malicious code or interfere with the security or operation of the Service
  • Attempt unauthorized access to accounts, systems, or data
  • Use the Service to create or distribute unlawful, harmful, or infringing content
  • Use automated methods to scrape, copy, or exploit the Service without authorization

8. Contacts, Photos, and Device Features

Some features may allow you to import contacts, upload photos or screenshots, create reminders, or enable notifications. You are responsible for using those features lawfully and for respecting the privacy and rights of other people whose information may appear in content you provide.

9. Subscriptions, Billing, and Purchases

Some features of the Service require a paid subscription. If you subscribe through the Apple App Store or Google Play, billing, renewals, cancellations, and refunds are handled by the applicable store under its terms and policies.

Unless otherwise disclosed at the time of purchase, subscriptions renew automatically until canceled. You can manage or cancel your subscription through your Apple or Google account settings.

Deleting your ExpressYou account does not automatically cancel an App Store or Google Play subscription. You must separately manage cancellation through the store that billed you.

10. Account Deletion

If you create an account, you may request deletion from within the app. Deleting your account is permanent and cannot be undone once completed.

Account deletion is intended to remove your account and associated data from our active systems, subject to retention required or permitted by law, fraud prevention, dispute resolution, billing records, or enforcement needs. We may take reasonable steps to verify your identity before completing deletion.

11. Intellectual Property

The Service, including our software, visual design, trademarks, branding, curated materials, and other content excluding your User Content, is owned by or licensed to ExpressYou™ and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal purposes.

12. Third-Party Services

The Service may rely on third-party providers, including authentication services, cloud services, app store platforms, analytics providers, and AI model providers. Your use of certain features may also be subject to third-party terms or platform rules.

13. Service Changes and Availability

We may modify, update, suspend, or discontinue all or part of the Service at any time. We do not guarantee that the Service will always be available, uninterrupted, or error-free.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

15. Limitation of Liability

To the fullest extent permitted by law, ExpressYou™ and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, use, goodwill, or other intangible losses arising out of or related to your use of the Service.

16. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless ExpressYou™, its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, and expenses arising from your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

17. Termination

We may suspend or terminate access to the Service if we reasonably believe you violated these Terms, created risk or harm, or if continued operation of your account would expose us, other users, or third parties to legal, security, or operational risk.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date on this page and may provide additional notice when appropriate. Your continued use of the Service after the updated Terms take effect means you accept them.
